The investment management industry has seen explosive growth worldwide. As securities markets around the globe continue their development, many investment advisers seek access to an international client base and crossborder investments. These trends, plus the significant impact of the Internet as a business medium, make the regulation of investment advisers increasingly complex and important. Recently, many countries have either implemented or substantially revised their investment adviser regulations, posing new challenges for advisers with an international business focus. In this environment, knowledge of regulatory schemes around the world is essential.

When this book was first published in 2001, the convergence of communications and computing had begun to transform Western industrial societies. Increasing connectivity was accompanied by unprecedented opportunities for crimes of acquisition. The fundamental principle of criminology is that crime follows opportunity, and opportunities for theft abound in the digital age. Electronic Theft named, described and analysed the range of electronic and digital theft, and constituted the first major survey of the field. The authors covered a broad list of electronic misdemeanours, including extortion, defrauding governments, telephone fraud, securities fraud, deceptive advertising and other business practices, industrial espionage, intellectual property crimes, and the misappropriation and unauthorised use of personal information. They were able to capture impressively large amounts of data internationally from both scholarly and professional sources. The book posed and attempted to answer some of the pressing questions to do with national sovereignty and enforceability of laws in 2001.

[Hedge Funds.

Given the international nature of the asset management industry, lawyers representing investors, asset managers, and regulators are often confronted with asset management agreements governed by foreign law. This book provides the necessary points of law and practice in the leading jurisdictions allowing lawyers to identify the main pitfalls concerning the foreign law in question. This book is the only comparative analysis of the law of asset manager liability in the major European jurisdictions, the United States, and Canada, each written by specialists from the relevant jurisdiction. This is a much-needed guide on the disparate regulation of asset manager liability in these countries highlighting the absence of uniformity in this area of law despite the implementation of MiFID in Europe. The section on European law provides an overview of the regulation in this field regionally and provides the context in which the national chapters explore the regulation at country level. The comparative evaluation at the end of the book provides a thoughtful assessment of the impact of regulatory frameworks on asset managers private law duties and liabilities. The Introduction situates the country-by-country material within the broader context of questions about regulatory design and effectiveness.
