Drawing on a wide range of resources to present a contemporary and evolving picture of human rights in the island states of the South Pacific region, the book considers the human rights aspects of constitutions, legal institutions and structures, social organisation, culture and custom, tradition and change. The materials provide legal, historical, political, social and cultural insights into the lived experience of human rights in the region supported by illustrative material from case-law, media reports, and policy documents. The book also locates the human rights concerns of Pacific islanders firmly within the wider theoretical and international domain while at the same time maintaining focus on the importance of the unique identity of Pacific island nations and people. Human Rights in the South Pacific will appeal to anyone interested in the region or in human rights including international rights advocates, investors and developers, policy-makers, representatives of government and civic society and those wishing to acquire a better understanding of what countries emerging from colonial rule face in developing but still retaining their identity.

Ulrich Schroeter analyzes the reasons for the influence of credit ratings and the characteristics of rating based regulation using four exemplary legal jurisdictions. On this basis he argues for the necessity of an addressee-oriented application of legal rules on publicity and identifies by means of a comparative approach the opportunities and limitations of ratings regulation without compromising the important role of rating agencies as independent sources of information. Ulrich Schroeter has been honored with several awards for his work. In this age of globalization many legal experts see evidence of swift global movement toward an eventual single "world legal system." Yet, the trend to political and economic integration in some parts of the world is matched by the trend to disintegration in others, where strong cultural and political resistance to external influences exists. Asia-Pacific Legal Development traces current and prospective developments in several legal systems of the Asia-Pacific region to make sense of these trends and counter-trends. The contributing authors represent a wide variety of specialist expertise, both "public" and "private," and together they encompass the three sectors that constitute a modern system of formal law: the economic, the behavioural, and the civic. Taking into account the opinions and perspectives of both indigenous and non-indigenous experts on topics ranging from prostitution to constitutional law, the book surveys how several ASEAN nations, as well as Canada, Australia, and New Zealand, are confronting social, economic, and legal change. In the first three parts, chapters are grouped along general sectoral lines to cover economic, civic, and behavioural themes, while in the fourth, cross-sectoral contexts are addressed. With the introduction and concluding chapter, the editors provide an overall integrating framework as well as provocative insights into trends in legal development in the Asia-Pacific region, and on comparative legal research and writing in general. Asia-Pacific Legal Development is not only an exemplary model for cooperative and comparative legal research and scholarly pluralism, but also a rich study of the increasingly relevant issue of convergence and divergence of legal systems, with a unique Asian focus.

In an era when special interests funnel huge amounts of money into our government-driven by shifts in campaign-finance rules and brought to new levels by the Supreme Court in Citizens United v. Federal Election Commission-trust in our government has reached an all-time low. More than ever before, Americans believe that money buys results in Congress, and that business interests wield control over our legislature. With heartfelt urgency and a keen desire for righting wrongs, Harvard law professor Lawrence Lessig takes a clear-eyed look at how we arrived at this crisis: how fundamentally good people, with good intentions, have allowed our democracy to be co-opted by outside interests, and how this exploitation has become entrenched in the system. Rejecting simple labels and reductive logic-and instead using examples that resonate as powerfully on the Right as on the Left-Lessig seeks out the root causes of our situation. He plumbs the issues of campaign financing and corporate lobbying, revealing the human faces and follies that have allowed corruption to take such a foothold in our system. He puts the issues in terms that nonwonks can understand, using real-world analogies and real human stories. And ultimately he calls for widespread mobilization and a new Constitutional Convention, presenting achievable solutions for regaining control of our corrupted-but redeemable-representational system. In this way, Lessig plots a roadmap for returning our republic to its intended greatness. While America may be divided, Lessig vividly champions the idea that we can succeed if we accept that corruption is our common enemy and that we must find a way to fight against it. In REPUBLIC, LOST, he not only makes this need palpable and clear-he gives us the practical and intellectual tools to do something about it.

Positive conceptions of ‘healthy aging’ are rightly displacing negative ageist perceptions of older members of our society. Nevertheless, at some stage, most elderly citizens will require some form of assistance from other members of society. When the body or mind begins to fail, a legitimate need for intervention and care will arise. This second volume on Aging discusses this theme.

English summary: In the course of comprehensive reforms of its judicial system, Japan completely overhauled its arbitration law in 2004, bringing the legal framework into line with the global standards of the UNCITRAL model law. Focusing on international commercial arbitration, Felix Burkei analyzes the development of arbitral practice in Japan, as well as its obstacles, against the backdrop of Japanese legal mentality. He gives a detailed description of the arbitral proceedings, in particular the arbitration rules of the Japan Commercial Arbitration Association (JCAA), a description which includes the recognition and enforcement of arbitral awards, an important factor for foreign parties. Felix Burkei evaluates Japanese and international literature as well as the judgments of Japanese courts on arbitration law. Since the previous flaws in Japanese arbitration have largely been eliminated, he concludes with a positive assessment of the reform.

This work aims to analyse substantive and conflict of laws rules regarding intermediated securities in a comparative way. For this purpose, it examines major jurisdictions’ rules for intermediated securities and the intermediated securities holding systems, such as the rules of the German, US, Korean, Japanese and Swiss systems, as well as the relevant EU regimes and initiatives. Above all, it analyses the two international instruments related to intermediated securities, i.e. the Geneva Securities Convention and the Hague Securities Convention. Through a functional comparative approach based upon legal traditions of the various jurisdictions, this book gives readers theoretical and practical information on intermediated securities and their national and international aspects.

Although the 1980 United Nations Convention on Contracts for the International Sale of Goods (CISG) is one of the most successful international conventions to date, it remains the case that those involved in the international sale of goods must refer to a multitude of laws. Indeed the CISG itself does not cover all issues relating to international sales contracts, so it must necessarily be supplemented by domestic law. Global Sales and Contract Law provides a truly comparative analysis of domestic laws in over sixty countries so as to deliver a global view of domestic and international sales law. The book reports on the real practice of sales law, taking into account present day problems. Complex questions on the obligations under a sales contract, the ways in which these are established, as well as the remedies following the breach of obligations, are all discussed. By addressing regional uniform projects, like OHADA, and comparing differences in domestic legal approach where the CISG would not apply, the work goes beyond existing commentaries which tend to focus only on the CISG. The analysis has been based on an unprecedented survey drawn from the world's top fifty companies as well as international traders, lawyers advising international traders, arbitral institutions, arbitrators, and law schools. This work encompasses all aspects of a sale of goods transaction and takes a wide view of sale by including general contract law. The book gives practitioners invaluable insight into judicial trends and possible solutions in different legal systems, whether preparing for litigation or drafting an international contract. Global Sales and Contract Law is the most comprehensive and thorough compilation of legal analysis in the field of the sale of goods and is a reliable source for any practitioner dealing in international commerce.

Adopted in many countries, with different degrees of enthusiasm, since its inception in the early 1970's, EIA is established as a major procedure for assessing the environmental implications of legislation, the implementation of policy and plans and the initiation of development projects. Providing a detailed analysis of the legal principles in England & Wales, this book looks at governing compensation claims for the lasting trauma caused by child abuse. Its pages discuss the merits and demerits of different forms of action as mechanisms for imposing liability for abuse, how compensable psychiatric damage can be proved and how the law deals with complex issues of duty of care, causation and extending limitation periods in the context of abuse cases. Whilst a substantial portion of the book deals with civil claims by the abused for the psychological harm caused by the abuse, coverage also extends to litigation by other parties involved directly or indirectly in abuse allegations. Also included is a significant comparative element, drawing upon jurisdictions such as Canada, Australia and New Zealand, as a means of speculating how our own legal system might develop.
